PROPOSAL: Claimed public right of way at Calder Park, Wakefield.

HIGHWAYS ACT 1980 – SECTION 119
DIVERSION OF A NON-DEFINITIVE FOOTPATH OFF DENBY DALE ROAD, WAKEFIELD
An application has been received from Peel Investments (North) Ltd to divert an unrecorded footpath shown by the solid line between points A-B and C-D onto the dashed line between points E-A-B-C-G on the attached plan.
Prior to this application being submitted the Council approved the making of an order to add the footpath to the Definitive Map and Statement. This order has not been made. The landowner disputes that public rights have been established. In order to resolve the situation the landowner has submitted an application to divert the path outside the Arnold Clark site and outside the future development areas.
The existing path passes through the car parking/display area of Arnold Clark car sales and then proceeds along an old farm access track that passes through future development sites on the Calder Park site. The proposed new route will be surfaced, at the applicants expense, and will pass on land outside the development and will link to an existing footpath at the northern boundary of the site. The existing route is 413 metres long whereas the new route will be 492 metres long, 2 metres wide and will be of a stone construction.
